Highlights of Pelican Ranch Covenants (updated July 2005)

 

Pelican Lake Ranch is a covenant-controlled community and has a Property Owners Association. The primary function of the Property Owners Association (POA) is to enforce the covenants, provide architectural control, community trash service, and other administrative and legal functions.  The POA annual dues are less than $400.00 per year.

 

1.           The Architectural Control Committee (ACC) must approve all Builders and building plans, landscaping, exterior colors, swimming pools, decks, out buildings, paddocks, fencing, satellite dishes / antennas, etc. using the ACC Design Review Request Form (DRR) available at the Community Information Center.

 

2.           In addition to plans, the applicant must submit a survey showing precisely the location of the proposed structure on the Lot. Its footprint must have a minimum setback of 50' from the front and both sides of the property, and 300' is the minimum setback from any O&G facility. (Utility easements are included in these minimum setbacks.)

 

3.           Sprinkler systems may only be installed on 5% of the area of your acreage home site.

 

4.           At least 10 evergreens and 5 deciduous trees must be planted during the next planting season after taking occupancy.

 

5.           Only 5% of the area of your acreage may be fenced with approved fencing materials, using the DRR form unless you have a designated horse lot, in which case, an additional 5% may be fenced as a paddock area.

 

6.           Perimeter fencing of your property is not allowed.

 

7.           Swimming pools must be in-ground construction and approved by ACC.

 

8.           Horses are permitted on Horse Designated lots only.  (One horse per full acre)

 

9.           Barns must be the same materials as the residence or as approved by the ACC

 

10.           Other than short-term guests whose vehicles may be parked for no more than 72 hours, no vehicles shall be regularly kept on the lot or street within the Project.  This includes but is not limited to:  Motorhomes, boats, unused vehicles, and recreational vehicles.  They must be kept within a garage or stored off site.

 

11.      No motorized off road vehicles are allowed.

 

12.      No hunting is allowed on any land within the development.

 

13.      Dogs and cats must be kept according to county regulations.

 

14.      Farm type livestock or pets are not allowed.

 

15.      No industrial or disruptive in-home business is allowed.

 

16.       Modular homes, kit homes, and trailers are not allowed.

 

17.       TV satellite dishes or antennas must be approved by the ACC.

 

18.      Access to the lake is via the marina or designated beach area only.  No swimming is allowed.

 

19.      Pelican Lake is a wakeless lake, which means only sailboats, canoes or boats with a maximum 5hp motor are allowed.

 

20.      Marina slips may be rented by the season from the Metropolitan District.

 

21.      The Metropolitan District owns, operates and maintains the streets and drainage, traffic and safety controls, transportation, mosquito control, water delivery system, the entry gatehouse,  community information center building, the recreational areas and amenities, open space, wildlife preserve and the marina.  If appropriate, the Districts may ultimately convey the public facilities/improvements to Weld County or another governmental entity.

 

22.      A portion of the property taxes paid by the property owners’ funds the Metropolitan District.

 

23.      The Property Owner's Association enforces the covenants, provides the architectural control, provides community trash service, and other administrative and legal functions.

 

24.      Each property owner receives one vote in the Property Owner's Association.
